In the Supreme Court, John Alton, an apiarist, of Upper Hutt, is seeking £23 ,12s fid special, and £2300 general damages frqm Frederick Charles Facer, in connection with the death of his wife, who was struck by defendant’s motor car near Upper Hutt on August 10. Negligence on various grounds is alleged. The defence ig vi denial of negligence and It is contended that the accident was due to Mrs Alton walking on the bitumen track instead of the metal at the side of the road, that she was wearing a. black dress which impaired visibility, and that fatal injuries were caused by her clinging to the bicycle she was wheeling, the wheel of which was caught by the car.
