Cl .aiming that an automatiic macii' ino for tho sale of phonographic films was a shop vyithin the meaining of the Act, the inspector' of factories recently appealed ito ,the Supreme Court against a magistrate’s decision that it was not '•a. shop. Mr Justice Smith’s judgment was given this morning. The automatic machine im question was erected against a telegraph pole. The judge hold that a shop must be a place capable of physical occupation by the occupier. He dismissed the appeal.
