SERIOUS CASE EE-TRIED. AUCKLAND, This Day. At the Supreme Court, in the rehearing of the case against Franklin John Smith, charged with rape, or alternatively with indecent assault, the jury after three and a half hours' retirement returned a verdict of not guilty of rape, but guilty of assault. Aecused was convicted on the major count in June last and sentenced to seven years' imprisonment, but an application for a rc-trial on tho ground <ihat the verdict was against the weight of evidence was granted by the Court of Appeal. * Mr Justice Stringer sentenced the accused to three years' imprisonment, dating from -his former conviction on " the charge of rape.—Press Assn.
