APPEAL COURT.

ALLEGED SHEEP DOG THEFT,

WELLINGTON, April 11

In the Appeal Court c?se of Rex v. Harvard, alias Shepherd, the prisoner was charged with stealing a sheep dog, and on a second count of receiving it, knowing it to be dishonestly obtained.

The jury found that there was not sdfficient evidence to prove that accused stole the dog

On the second count that the prisoner detained the dog, the verdict was that h2 did not know it had been stolen.

The Court held that the veridct was ambiguous and inconclusive, not showing when guilty knowledge arose, and ordered a new trial upon the second count at the next Palmerston North sittings.
