Compensation Claim

At a sitting of the Compensation Court in Palmerston North, the Hon. Mr. Jus tiee O'Regan presiding. William Slater Gardner, contractor, of Shannon (Mr A. M. Ongley) sought damages from William Joseph Moynihan and Thomas Patrick Moynihan, farmers, of Shannon (Mr. II R. Cooper). The statement of claim set out that plaintiff met with an accident on April 11, 1942, while employed by defen dants. Mr. Ongley stated that the accident had happened while plaintiff was riding a horse. It stumbled and when plaintift jerked on the reins to hold it up, he fell the muscles give in one of his legs. He had not been able to do any work since , on the farm or work of any heavy nature. , Evidence was given by plaintiff on these lines and he added that he was unable to put any weight on the leg. Mr. J. 11. North, superintendent of the Palmerston North Hospital, gave evidence of the treatment given to plaintift while he was in the hospital. Mr. Cooper said it was an extraordinary case in some ways. Plaintiff had been examined by doctors since the accident, i but there was no report from them before the Court, apart from a report by Mr. D. S. Wylie, F.R.C.S., and Mr. North, made 12 months ago. in which they stated 1 plaintiff was able to do light work. His Honour gave judgment for plainI tiff and allowed him 15 per cent. (12s a | week) of the total claimed for the period from July 8. this amounting to £133 6s 9d. Costs £ll 11s were allowed.
