Feilding Civil Claim

RESERVED JUDGMENT GIVEN. At the Feilding Magistrate’s Court yesterday Mr. It. M. Watson, S.AL, gave reserved judgment in the civil claim in which George H. Grindrod, contractor, of Feilding, sued Laura Coleman, law clerk, also of Feilding, for £152 16s special and £IOO general damages, arising out of a collision while ,tho parties were riding cycles. The case was heard a fortnight ago when plaintiff sought to establish that the accident arose out of tho negligence of defendant. After reviewing the evidence the Magistrate said that he held that the accident was due to negligence on the part of both plaintiff and defendant and tho negligence of plaintiff was so mixed up-with that of defendant as to make the negligence of plaintiff contributory to the cause of tho accident. Ho was unable to determine whoso negligence was the decisive cause and that being the case neither party could recover. It was impossible not to sympathise with plaintiff who was an elderly man with a family. He was severely injured w’liile defendant escaped scot free. Judgment would bo entered for defendant with costs according to scale. At the hearing Mr. D. C. Cullinane appeared for the defendant and Mr. A. M. Ongley for the plaintiff.
