Appeals by Burgess and Jenkins Upheld

RUNNING OP PUKEKO INITIAL CONCLUSION NOT JUSTIFIED Per Press Association. WELLINGTON, Last Night. The appeals by B. Burgess, own-er-trainer of tho horse Pukeko, and A. Jenkins, the jockey, in connection with tho running of the horse Pukeko in the first division of tho Jervois Handicap at Auckland, were upheld to-day by the Racing Conference judges on the following judgment:— The judges have very carefully considered the evidence taken before the judicial committee of the Auckland Racing Club and before the Auckland district committee, and also the evidence tendered before them on appeal, and the judges consider that, after giving duo weight to the expert evidence bf Mr Gomer, the stipendiary steward, and the stewards of the Auckland Racing Club, there is sufficient evidence from the surrounding circumstances to justify the conclusion that while the jockoy, Jenkins, may have erred in his judgment in riding the race, the horse cannot be said not to have been ridden on its merits. In the circumstances of the race we therefore uphold tho appeals of Burgess and Jenkins, and order the deposits on appeal to be refunded. The judges were Messrs J. S. McLeod, D. E. Wanklyn, and James McLeod.
