MOTOR COLLISION CASE CLAIM AND COUNTER-CLAIM Before Mr. B. M. Watson, S.M., at the Fcilding Magistrate’s Court, yesterday, lengthy evidence was heard in a civil action by Dustin's, Ltd., against William I. Pratt, after which decision was reserved. The action arose out of a
collision between motor vehicles belonging to the parties which occurred on the Bunnythorpe-Ashhurst road at the Glaxo factory corner on January 3 last. Dustin’s, Ltd., claimed £4G 16/ as special and general damages, while the defendant, Pratt, counter-claimed for £llß 2/. His car had been totally destroyed as a result of the smash. Plaintiff claimed that the accident, was duo to negligence on the part of defendant, while Pratt submitted that he was proceeding towards Ashhurst on his proper side of the road and t hat Iho accident came about, through plaintiff’s servant being on his wrong side of the highway and through his failing to maintain a proper look-out.
Mr. Bleunerhassett, of Wanganui, appeared for plaintiff and Mr. J. M. Mason for defendant.
