The quality of ice cream dispensed by James Duhovieli, of Palmerston North formed the subject of a court, case in Palmerston North yesterday, when Duhcvicli pleaded not guilty to selling ice cream containing less than Id per cent of milk fat as required by regulation. Inspector Huggins stated that in defendant’s shop was a barrel labelled ice cream from which an attendant served a customer who asked for ice ci earn. Mr. Grant contended that ices did not necessarily have cream in them. Senior-Sergeant Whitehouse stated that he had seen printed in bold skinch lettering on the window of defendant’s shop, the words ice cream whereas the card referred to was in small lettering and stuck away in a corner.

For the defenco it was contended that if the "icc cream” purchased by Inspector Huggins was an ice as alleged by defendant, there was no need to have any specific quantity of cream in it.

Defendant, from the witness box, said he had been making ices and ico creams for 14 years but just before Christinas last had decided to give up selling ice creams and continue with the ices only. His ice cream ices were much the same .as ice creams, the only difference being that he replaced a Quarter of a pint of cream with half a dozen eggs. The mixture really cost him more. He had given instructions to a signwriter to remove the ice cream sign from his window but the latter had not done so yet. If defendant wished to continue selling his cream ico mixture he had better call them "Ideal” ices and leave the word cream out of it. A fine of £2 with £1 7s 6d costs was imposed.
