MARBLE BAR CASE.
MINISTER NOT RESPONSIBLE. (Per Press Association.) WELLINGTON, Last Night. Mr Riddell, 8.M., heard an application to strike out the name of Hon. G. W. Russell, Minister for Public Health, in the marble-bar ease, heard on August 34th. Mr McAssey, who made the application, said that the order for closing the premises had not been made by the Minister, but by the district health officer. Assuming that the order was ultra vires, the plaintiff had no right of action, as ho should have ignored the illegal order. The order was perfectly valid, as it was necessary to prevent the spread of the epidemic. His Worship granted the application, and ordered the Minister’s name to be struck out.
