AN UNUSUAL CASE. A case of an unusual nature occn] pied the Magistrate's Court all yesterday afternoon in whioh George Powell (Mr Cooper) sued Miss J. B. Bland, of Wocdville, for the refund of £SO alleged to have been' a 1!"vanoed. It appaars that the parties were engaged to be marriad, and the plaintiff gave defendant £SO and a Post Office Savings Bank book with instructions, to pay the money into the Bank, and it was cootenied that.instead of doing tins defendant paid the monny into her own account. Plaintiff, who is a railway employee, said ha was engaged to be married to the defendant, but it was b'oken off. On Jnne 3rd ha handed her £SO and the bank book to place in the Savings Bank at Woodville. There was no one present at the' lime. Later on while in Taranaki he received a letter from Miss Bland asking if she should send the bank book to him, Plaintiff went to Woodville and got the book, but there was no entry of the £SO, but defendant promised to forward on the money. A week later saw defendant and it was arranged to get mairied the following week at Taihape. He saw her the next day and the engagement was broken off. For the delenca it was oonteuded that the money was given for the inconvenience to the defendant for breaking off the engagement. After hearing the evidence on both sides HisWorship reserved judgment.
