A Friendly Settlement

Very general pleasure will be felfc amongst settlers at the announcement which we are able to make this morning, viz., that a settlement has been arrived at, in the case of McHardy v. Knight md vice versa. : ' .. ■ It-.will be remembered that some weeks ago Mr Knight, a settler in the Newberry district, was discovered in the act of cutting a wire fence bounding the property of Messrs McHardy Bros. He was arrested and. brought into Palmerston on a charge of wilfully damaging property. When the case came on for hearing, eventually, Mr P. A. Baldwin, who appeared for defendant, pleaded that the latter was acting under a bona fide belief that he was within his rights, and the case was dismissed, the understanding being that a Supreme Court action would be brought to test the merits of the case. In the meantime counter proceedings for damages were being taken by Knighfi for wrongful arrest. An agreement has now been arrived at by which Messrs McHardy Bros, publish regret at ihe arrest of Mr Knight, pay him i'3so by way of solatium, and *he costs of the various proceedings, and also agree that the fences in dispute shall bo set back to the old boundary observed before the former took over the property, and that Boyes' road be in- ( creased to a width of one chain.
