FARMERS AT LAW

In the Supreme Oourt yesterday, before His Honour Mr Justice Johnston, two neighbouring farmers at Koputaroa were- participants in a civil action. Thomas G. McGill sought an injunction against William A. Spiers that defendant refrain from blocking a drain and thus preventing the natural flow of surface waters from plaintiff’s land. Spiers contended that his land was receiving water from a foreign watershed and that McGill had committed a breach of an agreement made in 1 9<‘l-j whereby a smaller drain was to be leftblocked. In a counter-claim Spiers asked that McGill bo ordered to Jill in this other drain and that the Court award Spiers such relief as might be just. His Honour inquired into the prospects of a settlement and was informed that this seemed unlikely. The hearing of evidence was then proceeded with and the case was expected to last until this afternoon. Mr G. Crossley appeared lor plaintiff and Mr M. B. Bergin for defendant.
