COLLISION CASE.

In April bust an action was comnieneed in the Feilding Magistrate's Court by William Christie, retired tanner, of Feilding. against H. W. James, carrier, ot Feilding. and B. F. Bell, lorrv-driver. of Feilding. wherein plaintiff claimed to recover from the defendants £299 2s in respect to damages lor personal Injury and injury to property allegedly arising put of a collision on August 2S 1040. The collision was stated to have occurred at Ranfurlv Road. Feilding. between a bicycle ridden by plaintiff and a lorry, the property of James and driven by Bell. Defendants took sti ps to have the action moved to the Supreme Court for trial and an order was made by the Supreme Court removing the action accordingly The matter came l>ef'ore the Chief Justice (Rt. Hon. Sir Alieliael Myers) at Palmerston North on Thursday, when Air 1). C. Cullinanc mini'"red for nlni’diff and Atr John Graham for defendants. Mr Cullinanc in f imated to the Court that plaintiff did not propose to proceed with the claim and elected to take a non-suit. His Honour non-etr.ted plaintiff accordingly with costs against him.
