EXTRA PAYMENT.

CLAIM NOT UPHELD. Per. Press Association. DUNEDIN; "Aug. 22. In the Magistrate’s Court, Mr Bartholomew, S.M., gave judgment for defendant company in a test case in which Ross and Glendinning, Ltd., woollen mill owners, were proceeded against by employees for extra payment for 19 shifts at 3s a shift as adult workers by virtue of the labour legislation suspension order. The Magistrate gave leave to appeal in view of the important principle involved. Mr Bartholomew said the plaintiffs’ contention that .ordinary workers on a day shift were equally entitled with night shift workers to the extra pay was invalid. The difference between shift work and ordinary work was recognised by clause 4 of the suspension order. Plaintiffs’ position had not been in any way affected by the working of the night shift. .
