LEGAL ACTION.
ARGUMENT ON DAMAGES. SYDNEY, March 11. Legal argument began to-day on the question of damages in the action B. Davis, Ltd., v. .Tooth and Co., Ltd., but was not concluded. Application was made to reopen the case to enable fresh evidence to he tendered as to the sale values of a certain brand of whisky. Mr Justice Halse Rogers rejected the application. A cable dated March 7 stated that judgment on a number of important issues in favour of R. Davis. Ltd., wine and spirit merchants, London, in a claim for £250.000 against Tooth and Company, Ltd., had been delivered by Mr Justice Halse Rogers in the Commercial Causes Court. . The amount was claimed as damages for breach of a contract under which the defendant company accepted an agency from the plaintiff company to sell certain whiskies in New South Wales.
