CLAIM FOR DAMAGES.

PACER INJURED BY BULL

Per Press Association

AUCKLAND, Sept. 11. An action arising out of the loss of the pacing gelding Silver Bingen, which it was alleged had to be destroyed after it had been gored by a dangerous bull belonging to defendant, was heard in the Magistrate’s Court to-day, when the owner of the horse, Mrs I. E. Sweetapple, claimed £152 damages, including £2 2s veterinary sur-

geon’s fee, from Hugh Iledley, farmer, of Auckland. In the statement of claim plaintiff said Silver Bingen had been delivered to defendant on April 13, and in return for caring for the horse he was to receive 5s a week. It was alleged that owing to defend ant’s nogligenco the horse was attacked by a bull in the same paddock, with the result that the horse had to be destroyed on May 22. The defence was that there had been no contract between plaintiff and defendant and that defendant was not guilty of negligence. The case was adjourned until to-morrow.
