The Court gave its decision in re- ' gard to the cases heard a fortnight ago as follows:—Est. of W. A. Sandilands, unimproved valuation £595, sustained ; W. A. Sandilands, unimproved valuation £l2lO, reduced to £855; Est. of W.. A. Sandilands, unimproved valuation £6OO, sustained; B. N. Sandilands, unimproved valuation £3Bl, reduced to £300; W. A. Roots, unimproved valuation £220, reduced t-o £2OO. These reductions total £SBO in unimproved valuations and represent in the matter of rates a loss to the borough of £2O. The Court then heard evidence in regard to applications for relief on land formerly in the borough but now forming part of the Oroua County. The town clerk, in evidence, said that the Borough Council did not make and levy rates in respect of the properties mentioned. They were now part of the Oroua County and for the time being the Oroua County Council was responsible for the making and levying of rates on the excluded property. Asked by Mr B. N. Sandilands as to how the borough came to increase the special rate, witness pointed out that ' at the time of exclusion certain of the , debentures ■ representing loans for which this laud was pledges! had not I been sold, and their sale after exclusion naturally caused the special rate to increase slightly. R. L. Harding, Oroua County clerk, said that the special rates were originally made and levied by the Borough Council and when the County Council took over the property it also assumed responsibility f.or the making and levying of the special rates. Asked by the chairmau who made I and levied the rates of the excluded J land last year, Mr R. L. -Harding stat- i ed that his council did. i To Mr Sandilands, witness was ah-1 solutely certain.that this was the case as his council was the only body that knew what rate to levy. The chairman said that on the facts! the Court would have to rule that the ; excluded sections were not urban farm j lands within the meaning ef the Urban Farm Lands Act, 1932. I The Court then adjourned.
