James Cox, caretaker of the Square reserves, stated that he had observed accused taking flowers. He had leaned his bicycle against a seat and had ninde a selection from different beds. He had then been accosted. Plants had been taken from time to time, but accused could not be said to have taken them all. Accused did not appear, but in a letter denied the charge. However, ho stated, he did see two plants with blue flowers, and in between them was a r<*l plant in bloom, while there was also a blue one. The colours had not blended and he had picked the one bine flower. Anyone, he proceeded, who knew anything about botany should have removed the blue plant and transplanted it. In his opinion, tho person who laid the charge should bo admonished for wasting the Court s time over such a trivial matter. His Worship fined accused £2 with 10s costs. .
