MR GRAY FOR THE DEFENL'E, (Peb Pbess Association.) WELLINGTON, Oct. 20. In the Appeal Court Mr Grey. K.C., opening the defence for Heard, submitted that until,this charge his client had borne an honoured name, and while admitting he had acquired an interest in Kcrchoma's land, the Court must find some deliberate fraud on his part to bring him under its jurisdiction. Much of the evidence was against Chennells and not against Beard, [le contended that outside of the formal affidavits, those making them were either interested or seeking to justify their own acts. He also pointed out that Kerehoma had not supported the Law Society's action. He churned that there was nothing to suggest that Heard knew Kerehoma was impro. vident. The [lower of attorney prepared by Heard was necessary, as Kerehoma was living in Ilawke's Hay.
