LOST TRAM TICKET.

AN INTERESTING CASE. AUCKLAND, April 7. Proceedings were taken at the Police Court to-day by the Tramway Company against T. Wake on a charge of riding on a tramcar from Onehunga to Auckland on December 31 last without paying his fare. The facts of the case were admitted by both parties. Defendant had bought a return ticket to Onehunga and lost it. When he got on the car for the return trip to Auckland the conductor demanded a fare. This defendant refused to pay, saying he had bought a return ticket and lost it. Proceedings were accordingly taken. There was no suggestion of any fraud on the part of defendant. Mr Richmond, for the defence, raised a point of law as to whether the company had a right to sue, seeing that they had not complied with Clause 31 of the Tramways Act, which states that a list of the tolls or charges should be liung up in a conspicuous place inside the tramcars. The magistrate held that counsell's point did not relieve defendant from the obligation to pay his fare. There was no question of fraud involved, so a nominal penalty of os was inflicted, with costs £2 16s.
