MAN SHOT DEAD.
In the Criminal Court at Adelaide, on Wednesday, February 23rd, Harry Bachmann, aged 23 years, was placed on trial, charged with having murdered Edmund Day Davis, aged 61 years, at Glenelg, on January 22. Margaret Howe, single woman, said that she came from Salisbury with accused on a holiday, and went to Glenelg. They went on to the sandhills at 4 o'clock. She saw Davis, but Bachmann told her to take no notice of him. A few minutes later she saw Davis behind a bush on his hands and knees. He got up and ran towards the beach. A little later she told Bachmann that Davis was again behind the bush. He began creeping on his hands and knees. Bachmann got up and went over the sandhill. She heard a man named Noy, who was with Davis, say, "I'll do for you, my boy, and your revolver." She heard the report of a shot, and Bachnianu said to Noy: "If you come a step further, I'll shoot you." Shortly afterwards Bachmann returned to her and said, "I've shot a man."
Cross-examined, witness said that after the shooting, Bachmann said: "I shot without thought; I shot to frighten them."
William Noy, who was with Davis, denied that he and deceased were parlies to "foxing" and blackmailing on ihe sandhills. lie never knew thai, Davies had received a hiding for blackmailing.
The jury, after a retirement of 35 minutes, brought in the following verdict,: —"We find accused guilty under strong provocation, of the reckless use of firearms, which, in our opinion, amounts practically to manslaughter. On account of his youth we bring in a strong recommendation to mercy." Sentence was deferred.
