RESIDENT MAGISTRATE'S COURT, NASEEY. ■ Thursday, May 25. (Befoue S. Mead Dalgliesh, Esq., K.M ) AgnewV. Graham—Graham v. Agnew. Iu these cases, which were heard at St. Bathans, His Worship delivered judgment here as follows :
I find that there was an implied contract between the parties in these cases. There is no doubt in my mind that Agnsw agreed to pay something'for the fence, but lam not satisfied that Graham should recover interest on the original. cost of the feuce, but he (Graham) should recover interest on the value in ISB7, which 1 find to be 8s per chain. Reckoning on this basis,-the balance between the parties is lis id in favour of Aguew, for which amount, together with 23s costs of court, judgment will be entered up. .-■';.".
