NELSON, March 20. A decision of importance to publicans was given at Motueka by Mr. Evans, S.M., in a -case where a licensee was charged " with selling liquor to a lodger, alter closing hours for consumption off the premises. Th© -Magistrate found that the lodger purchased the liquor bona fide, and- at' his own. expense, for the purpose of entertaining'friends in a drive on the Sunday. He held the
lodger was -not entitled to constitute himself an agent • for purchasing liquor for a party,' but subject to this his right to purchase under exception in his own favor was' so extensive, and with the landlord's right to sell under hlis license, that the Magistrate was satisfied that the lodger had purchased .a - reasonable quantity of liqupr in his1 own behalf^,1 .and not as agent for the party, and dismissed the information.
