Sir, Mr Sinclair’s letter in your hist. is.mo is all beside the main question, whieb is divisible into two parts : (1) Have the Government really conveyed to the Trustees of the Scotch Chare h, land"rffl ieh' dr I init"'bPlsTiy*To”n7e ( > o verimamF. (2) Could they so convey it by any possible means? The fact appears to be briefly thus: A deed was made and sinned by the Governtuent purporting to convey certain lauds by autliority of the Charitable Trusts Act. But as the Act in question did not authorise the conveyance of anythin}* more than “ part of section 452,” which alone belonged to the Province, the deed is invalid as regards any other lands which might be included. Of course, it would be less conducive to future, mistakes if the deed did not exceed that authorised, and, were I a Trustee, I should endeavor to have a deed made as indefeasible as possible, and not run any risk of future contention as to the ownership of the land now occupied. Had they met the enquiry at first in a spirit of candour, it would have been better, and looked more honorable, but that they should continue silent is really surprising. It looks as if they were waiting to take advantage of any opportunity that might turn up to retain the land, rather than uo the thing that is right.—l am. &c..
