John .Mclx>an and Son, tlx* litigation arising l)ll t <>f the stopping of tho Wellington Dock contract, tho Chief Justice (Sir Robert- Stout) held that there was not an undertaking on the part of defendants to order sand and gravel beyond what was required. Counsel for defendants asked for judgment on a claim for .€20,0(10, contending that the effect of Sir Robert Stout's decision was that plaintiffs had no cause of action. The motion for judgment was deferred till Wednesday next.
