His Honor Mr Justice Williams on Monday delivered judgment in the suits Bank of New Zealand v Walter Guthrie and Co., and other allied companies, the hearing of which was concluded on the 2nd of July last. The judgment is that the plaintiffs are entitled to a decree in each action, and the form of the decree is to be submitted and brought up for discussion in Chambers.

When the action, Public Trustee v Sir Walter Buller and Major Kemp, came on at the Supreme Court, Wellington, on Wednesday, Mr Cooper, on behalf of plaintiff, unreservedly withdrew all allegations against Sir Walter Buller, and admitted that there was no evidence to support them. The action was technically to test Sir Walter's title to two small sections of 11 acres, and his leases and mortgage in the famous Horowbenna block. There were also in the statement of claim, charges of fraud. Mr Cooper said these could not be supported and Sir Walter Buller was completely exonerated. Mr Bell appeared for Sir W. Buller and Sir R. Stout for Major Kemp. After argument the Chief Justice said both defendants were entitled to full costs.

Consequent on no improvement in his health, Mr H. S. Fish, M.H.R., Dunedin, has resigned his seat as a councillor in the City Council; hut, the 'Daily Times' says that the acceptance has been deferred so that tbe election of a ratepayer to fill the vacancy may be held simultaneously with the annual elections next month.
