Trent v. D. Reece. This was an action for the recovery of £2O on account of damages to plaintiff’s trap, alleged to have been caused by the negligent driving of men in the employment of defendant, Mr Wynn Williams was counsel for the defence. It appeared that a collision had occurred between plaintiff’s dogcart and one of defendant’s drays while being drivendn opposite directions on the road near the cricket ground. The evidence for plaintiff went to show that he was driving along the road at an ordinary pace, and that while on his proper side of the road a collision oecurred with defendant’s dray; but it was shown for defendant that although the night was dark plantiff, who had no lights on his trap, was driving at a very rapid pace, quite nine miles an hour, and that there was ample room for him to have passed between the dray and the footpath if he had exercised ordinary care, the space between the two being over eighteen feet. His Worship gave judgment for defendant, with costs £3 10s. . *
