CHRISTCHURCH. Tuesday, Apbii 17. (Before C. C. Bowen, Esq., R.M.) _ Hugh Jordan, charged with being drunk and incapable, was fined ss. W. S. Paterson, charged with a similar offenee. was discharged with a caution. own CASES. Masgix v. Buxios.-This was a claim for* damages for trespass of three horses. Judgment was given for the full amount. Jomf Catoill v. D. McLstLAN.-This iras a claim for £l9 lis for goods sold and delivered. It appeared from the evidence of plaintiff that defendant had tho goods to sell or return, and 20 p. c, was to bo allowed on cash being paid for the goods sold. Plaintiff now sought to recover the balance due on account of goods supplied to defendant. Defoudant had £ll in hand for good* sold but instead of paying it over he went to the diggings. Defendant said that a quantity of goods, to the value of £Bl2s 2d, had been stolen from him; h<> admitted that he owed £lO 7s. ' His Worship said that defendant could not bo liable for the amount of goods absolutely lost. He would give judgmont for £l2 4s 81 ■ Pbicb ami) Waiker v. Cook. This was a claim for £8 2s 6d, for photographs supplied. Plaintiff appeared in person, Mr. NaMm for tk defendant. The defenco was that the quantity supplied was in excisa of the order, and that tho goods had been returned. ' The Court held that defendant had not used due diligence in returning tho goods, Judgment must be given for plaintiif, and tho goods must he handed to defendant. Powbu v.
