SALE OF LIQUOR.
DURING THE EPIDEMIC. GAZETTE NOTICE INVALID. Wellington, Saturday. A local publican was prosecuted for selling liquor when the hotels were required to be closed during the epidemic. The defence took the line that the men served were boarders living in an hotel, ard that the authorities had no power to cancel tnat portion of the Licensing Act, which Bllowed boarders to be served. Beyond this it was contended tbat the selling of liquor had never been legally prohibited, inasmuch bb the Gazette notice required the approval of the Minister before it became operative, and there was no evidence of such approval. Mr Frazer, S.M., upheld this contention and suggested that the Health Department did not understand its own order. There was no statement of approval by the Minister given in advertisements publishEd by the De partnaent, and no proof that it had ever been given. The information was dismissed.
