TE KUITI POLICE COURT.

Thursday, November 22nd,

(Before Mr H. W. Northcroft, S.M.) A number of Te Kuiti storekeepers (Messrs F. Darrow, James McNaught, John Nicholls, E. Corban and Mrs Bowden) were charged with keeping open on October loth, a statutory half-holiday. It was explained that the day in question was a sale day and the defendants had applied to the Factory Inspector for permission to keep open, a reply being received to the effect that the Inspector had no power to grant the permission. Under the circumstances, His Worship considered the case would be met by defendants paying the costs in each case.

A further charge of a similar nature against E. Corban was adjourned until next Court day.

Green and Colebrook v. Lovett and Adams. —This was an old claim for goods supplied to H. Adams during the progress of a bush contract at Poro-o-tarao in 1900. The receipt of the goods by Adams was admitted, but Lovett stated that he only guaranteed the amount of the account to the extent ef £IOO, and was not a partner of Adams'. Evidence in support of the claim was given by Green and Colebrook. G. Mayo, who was manager for Green and Colebrook at Poro-o-tarao at the time, and the books of the firm showing the account made out in the name of Lovett and Adams were put in. For the defence, Charles Lovett and Henry Adams gave evidence supporting Lovett's statement and affirming that when the bush was taken over by Ellis and Burnand it was agreed that they (Ellis and Burnand) should pay off the account to Green and Colebrook. After hearing counsels' addresses His Worship delivered judgment for plaintiffs for £2113s iod, and costs £6 I2s, the sum of £5 to be deducted from this amount if it was shown by Lovett that Mayo was equally liable with him for £lO, portion of an amount of a bond.

Judgment went by default in the case of Franklin v. Standish for the sum of £6 16s, and costs £2 18s 6d. Judgment Summons. —V. S. Hattaway v. H. Hau— Claim £35 Iss Order made by consent for payment of £1 per month.
