DISPOSAL OF REFUSE

PAEROA PROSECUTION

Charged with depositing or casting bullock heads, sheep heads-, bones, refuse and offensive matter on ’the roadside in Bennett street, Paeroa, on July 19 last, Outram Marshall Young, of Paeroa was summoned before Mr W. H. Freeman, S.M., at a sitting of the Magistrate’s Court in Paeroa on Monday last and was convicted and fined £2 with 10/- costs and solicitors’ fee £l/11/6.

Mr R. J. Harris, of Paeroa, ap’peared for the informant, Mr W. Oliver, health inspector, who stated in evidence that he had received a complaint relative to the depositing of’ offensive matter in Bennett street. He reported the matter to the police and in company with the borough foreman investigated the matter. He ascertained tliat the offensive matter had. been taken from the Paeroa racecourse following a hunt meeting. The

hounds had been fed at the racecourse.. Mr Oliver went on to state that defendant had admitted -depositing- the* refuse in Bennett street and had agreed to remove all the offensive matter. Some days later witness had inspected Bennett street and found a bag of sheep’s bones further up front where he. had seen it before.

In answer to questions from Mr D,. G. Sinclair, who appeared for defendant, witness said he understood that defendant had admitted responsibility for all the refuse being in Bennett street. Defendant did not state that, he admitted.responsibility for the bullocks 4 heads alone. Everything except one bag of refuse was removed.

In opening for the defendant Mr Sinclair stated that defendant had; commenced to remove bullocks’ heads, from the course and whilst engaged inremoving them had been called away to unload a truck of fertiliser which was urgently required and he accordingly took the bags of refuse off the truck, placing theta on the side of the' road in Bennett street and he proposed to attend to their disposal after he had finished handling the fertiliser. Defendant, said Mir Sinclair, knew nothing about the sheep’s heads at all and he admitted no responsibility in. connection with them. His client had not seen them nor had he removed them from one place in Bennett street: to another.

The magistrate stated that he must enter a conviction and accordingly imposed the fine as stated above.
