CONCERNING A TENDER

DUNEDIN, Oct. 23

A meeting of the Technical School managers was held to-day to consider the position which has arisen with reference to the contract for the new building. The Board recently accepted a tender for £30,999 for the erection of a new school, and rejected a tender for £30,059. Subsequently a question arose as to whether the meeting was properly constituted, and legal advice was sought on this point. At to-day's meeting the legal opinions were received from Messrs W. C. MacGregor and J. T. Woodhouse, who expressed the view that the meeting at which the tender was accepted was illegal, on the ground that one member at the meeting had forfeited his seat owing to non-attendance at previous meetings, and another manager did not receive notice of the meeting. Consequently their advice was that acceptance of the tender was not binding on the Board. It was moved that the lowest tender, that of McLellan, be accepted, but an amendment was carried referring the matter to a sub-committee of four to report at next meeting.
