TO-DAY'S COURT.
(Before Mr A. Turnbull, S.M.) Judgment was entered for plaintiffs with costs in the following undefended cases: M. C. Lawson and Co. v. S. Kelly, £17 18s Id; J. C. Gillett v. S. H. Harrison, £1 4s 6d; same v. A. Lester, 15s; M. C. Lawson and Co. v. J. Hokio, £10 16s 7d; R. J. Hughes v. H. J. Bedford, £2 6s; J. W. Lash v. T. Hokio, £1 4s. H. A. Jenkins, of Hawera, cabinetmaker, v. B. D. Climie, surveyor's assistant, claiming £58 12s 4d for goods supplied and work done. The defendant paid £38 12s 4d into Court, and the plaintiffs discontinued action for the balance of £20. Mr McCarthy, who appeared for the defendant, asked for costs on the discontinuance action. He had spent a lot of time in" preparing for the hearing, and he thpught his Worship had the discretionary power to grant costs as requested. Mr Sellar, who was for the plaintiff, submitted it was not a case for costs on discontinuance. The • defendant had admitted by far the greater part of the claim. His Worship said he had had a similar- case at Stratford recently. He would look into the present case and give his decision later.
