THE APPEAL CASE.

Before the Appeal Court, in the case 1 against the Feilding Gas Co., Dr Find- j lay, Attorney-General, contended that the borough was not prohibited tinder '• 1 the Municipal Corporations Act from contracting with the defendant company for the supply of gas to the inhabitants. Section 220 of the Act gave them full power, and that section was not controlled by section 222. Failing , that there was an implied authority in the borough, by virtue of its ownership of the streets, to authorise any person to do anything to the streets which did not. actually amount to a nuisance. Sections 240 and 422 recognised this authority. Dr Findlay further contended that the company committed no nuisance, and in a small borough with wide streets like Feilding the company could carry on operations without committing a nuisance. The case is proceeding.
