GISBOHNE, September 55, A case of importance to those, interested in dairying was decided to-day. It *vas that of Arthur Morgan v. the Poycrty Bay Cooperative Dairying; 'Company, a claim for £49 12s 4d. Th»?aaialgama? »ion of two dairying compauiUs led to areduction in expenses, and the question, was whether such a coatpany was engaged on a yearly hiring. Evidence had beew Vaken in other dairying centres. The: Magistrate stated : "It is clear that at the* time of tyJUmtifTs engagement no term was. men.tfctaed, and that being so I am oft obfoion upon the evidence as to* custom in the particular business for which he was. engaged that it was a yearly, hiring and! therefore that plaintiff could not legally' be discharged nor his salary reduced tul the expiration of tho current year. Plaintiff was entitled to judgment for th» imount claimed, cost* of court,, and oiherexpenses (including the taking of evidence »t EltHam, £10 3s 9d), totalling £JU> fe 9d. A simple written agreement ; would have obviated any trouble."
