His Honor Justice Martin gave judgment in banco in the case of Arrowsmith ' and others v Manning and others, which came before the Court on an originating summons issued by the executors under the will of John Manning las plaintiffs) against Mary Ann Manning, widow, and 1 certain children of deceased (as defendants). The main question was whether an order made against deceased by, the j Stipendiary Magistrate at Wellington for payment of maintenance money for Mrs Manning continued in foroe notwithstanding testator's death, and if it did what was the effeot of seotion 34 of the " Destitute Persons Aot, 1894." His Honor said Mrs Manning had not any enforceable claim against her husband's estate, and it seemed to him that if seotion 24 did apply to the order in question the liability of the hatband was a personal one, terminating with his life, and the contention that the operation of that seotion was confined to recovery of arrears up to the date of the husband's death must prevail. The case was not one for costs, except thai plaintiffs would have their ooiti as between solioitor and client out of the "•state.
