Wednesday, 28th Juke. (Before C. C. Kettle, Esq., R.M.) CIVIL CASES.

Mark Johnston v. Emily Clark.— Claim, JE27 15s 6d« for goods supplied. Mr Matthews, for defendant, asked for an adjournment on aooount of the defendant's absence in Wellington preventing her putting in a set-off. Mr Caplen, for plaintiff, objected, and stated that the defendant had threatened to file, which plaintiff wished to enforoe. He produced a letter from defendant offering to pay 5s in the £, and afterwards a telegram offering 10s in the £. The R.M. ruled that there was no gronnd for granting an adjournment, and gave judgment for plaintiff with costs.

N. Johnston v. Emily Clark.— Claim, £63 Is lOd, for goods supplied. Mr Caplen for plaintiff; Mr Matthews for defendant. The defendant had forwarded partionlars of a set-off, which bad not been put in. Judgment for plaintiff, with costs.

Adamson, Pease and Co. v. Allison Claim £1 4s 10d, goods sold and delivered. Judgment by default, with costs. Mr Welsh for plaintiff.

Same v. Somers. — Claim £1 5a 2d, goods supplied. Judgment by default, and costs. Mr Welsh /or plaintiff. Same v. H. Divehall.— Claim £3 5s Bd. Jndgment by default, with costs. Mr Welsh for plaintiff.

Same v. White.— Claim £5 2a 2d. Defendant appeared and said the account had been owing for sis years, and he thought it was forgotten. He bad worked two days for plaintiff, for which he was entitled to 16s. He could not pay it at once. The B.M. said plaintiffs would doubtless not press unduly on him ; and plaintiffs agreed to take even Is 6d per week. Judgment for amount (less 16s), to be paid in instalments of Is 6d.

A CHARGE OF ALLEGED PERJURY.

Robert George Marsh was charged, on the information of Edward Charles Meredith, with having, on April 12tb, at Hawera, committed wilful and corrupt perjury in testimony given by him as a witness in a case between the said parties, heard in the R.M. Court. The alleged perjury i 3 contained in the following statement by Marsh :— " The said Sbarkey came to me and asked for credit. I refused him oredit, when be went oat and fetched Meredith. Meredith afterwards came in with Sharkey, and said, 'Let this man have what he wants : I will be responsible.' I would not have given Sbarkey credit without Meredith's guarantee."

Mr Matthews appeared for the prosecutor, and Mr Barton for defendant. It was arranged to take the evidence of two witnesses, and adjenrn the bearing for a fortnight.

Sergeant Sfcagpoola, bailiff of oourt, gave evidence as to the swaaring of Marsh.

William Sbarkey, laborer, on East road — Had dealings with Marsh in January, 1892 ; took a subcontract from Meredith on 2nd Jannary, and started work on the 7th; when he took the subcontract he asked Marsh if he wonlcJ serve him with goods ; showed Marßh the agreement be had from Meredith ; Marsh asked him if

he would «iye him an order on tht oounoil, and he told Marib the council would not recognise an order; Marsh then said he would supply the goods; there was no aeouiity given ; Marsh tent an aooount; disputed one item in tht^' account ; had a conversation with Marah^: at Henry's sawmill, when he asked witness to give an order for his wages on John Henry ; refused to give ths order, but offered to pay 103 a month ; Marsh demurred a little, saying the amount was small, bnt witness refused to give tbe order; Marsh asked witness several times lor the money, bat he stated he wonld pay him by degrees.
