Ho had been for some time in the asylum. A boy named Greenwood, sis years old, was killed near Pabantanui on Saturday. He was crossing a bridge when the stringer broke and overthrew the truck on which he and other boys were riding. Greenwood had bis chest crashed and neck broken. The others were unhurt. The Magistrate held tbe engagement was merely a defeasible contract, terminable at any time, but the defendant neglected to send a notice to tbe plaintiff, and the plaintiff was equitably entitled to expenses and the loss of time incurred through this neglect. His Worship assessed the damages at 40s and costs. The decision governs several cases and defendant wbb granted leave to appeal.
