DECISION IN LEVIN COLLISION CASE. The case was one in which the negligence of both drivers was so nearly contemporaneous that neither had a reasonable opportunity of escaping the consequences of the negligence of the other, slated His Honour, Hr Justice Ostler, in dismissing the appeal ol: Mary St. Clair, of Levin, against the decision of Mir J'. H. Salmon, SAL, in awarding a non-suit on appellant’s claim against Margaret Greig, of Levin, for damages incurred as the result of a collision between her motorcar (driven at the time by her husband, Robert St. Clair, taxi-driver) and Miss Greig’s car. The accident was caused by the practically simultaneous negligence of both drivers, stated His Honour, and therefore the negligence of St. Clair was contributory, which was a defence in an action by Mrs St. Clair against Miss Greig. Costs were allowed Miss Greig.
