Tolley’s £looo Balm Withheld on Appeal
FEY'S ONE UP. Received Tuesday, 8.15 p.m. LONDON, Nov. 26. The Appeal Court upheld Fry’’a Ltd. appeal from the Supreme Court judgment awarding Tolley, the golfer £IOOO. The Court held that though Fry’s action in not obtaining Tolley’s consent to the advertisement was ineonsistant with the decency of life, it was not defamation. Tolley, the English golf champion, * sued Fry’s, the chocolate firm, alleging defamation through an advertisement which the - firm published without his consent. Tolley declared that his amateur status had been impugned by such an advertisement.
