POWER AGREEMENT CASE

DEFENCE CONCLUDED. HEARING ADJOURNED TO CHRISTCHURCH. The case in which tho Hawke’s Bay Electric Power Board seeks tho recovery of £2803 allegedly due under guarantee by Thomas Borthwick (Australasia), Limited, was continued yesterday afternoon before Mr Justice Blanin the Supreme Court at Napier.

After the case for the defence was concluded his Honour intimated that h’o would adjourn it to Christchurch. Plaintiff was represented by Mr J. B. Callan. Mr 11. F. Johnston, K.C., of Wellington, and with him Mr J. Maefarlane Laing, of Masterton, and Mr A. C. Jessep, Wellington, appeared for the defendant company. Frank Stanley Email!. chief engineer at the Canterbury Freezing Works of Thomas Borthwick and Sons., Ltd., said that at tho time of thp earthquake he was engineer in charge at the Pakipaki works. The essential, portions of the works were destroyed, and the company unable to continue its normal operations. On the afternoon of the earthquake, illness said, Benjamip, the PowerBoard’s engineer came out to the works. He informed witness, in reply to a question that power would not be available to Borthwicks for at least a fortnight.

To Mr Callan: He could not say whether the electrical equipment at the Pakipaki works was capable of functioning or had ever been available.

With the conclusion of SmaiH’s evidence Mr Johnston said this closed the evidence for the defence, whereupon His Honour intimated that he would adjourn the case to Christchurch. The day upon which the hearing shall be resumed has to be determined, but quite probably it will be a fortnight hence.
