CONTRACTOR ON TRIAL. AN AUCKLAND CASE. By Telegraph—Press Association Auckland, Oct. 31. Ernest Cheadle, aged, 30, a carrier and contractor, is standing his trial in the Supreme Court to-day on a charge of perjury. It is alleged that the accused gave evidence in a Supreme Court case in which damages were claimed for negligence and that he said he saw the accident which led to claim, whereas he was not in the vicinity and did not see the accident. The Crown Prosecutor said that the accused was the only so-called eye-wit-ness produced at the hearing of the claim and the result of the hearing was the award of £lll6 damages to the plaintiff. It was alleged that the accused subsequently told another man that ho got £l3O out of it. Percy James Watts, insurance manager, said that his company held the liability. Cross-examined, lie said that tho company had not paid the claim yet. Their cheque was ready, provided payment was legal. They had applied for a re-trial of the action. Counsel pointed out that the accused could not have received any money as alleged if tho cheque had not been paid. Counsel remarked that he presumed this action would have a very material bearing on the company’s payment. The Judge interposed that payment of the insurance money had no bearing - on the present case.
