‘ ‘ UNCONSTITUTIONAL ASPECTS. ’ - POWER BOARD CHAIRMAN’S CRITICISM. By Telegraph—Press Association. Gisborne, October 29. At the Poverty Bay Power Board meeting, the chairman referred to what he called the unconstitutional aspects of the Sinking Funds Bill. The Government, he said, had admitted the Public Trustee, the defendant in an action brought by the board, had been permitted to draft the Bill, which was thus a piece of legislation drafted by a defendant litigant otherwise bound to pay over moneys to the board and who was supposedly guaranteed by the State, which was bringing forward the legislation. The Government refused to insert the usual clause protecting a pending litigation and so placed the Trustee in a position resolving in his own favour questions at issue. Constitutionaally, if such legislation were passed, the board could petition the King and the British Government could disallow the measure.
