Mr. J. S. Rapley has been confined to his home for the past week owing to illness (pleurisy). Mrs. W. Thompson, of I’orangahau. is a patient in the Waipukurau Public Hospital. Mr. C. An important written judgment was delivered by Mr, A. M. Mowlem, S.M., at Waipukurau. yesterday. The claim, which was heard at the May sitting of the Court, was by Messrs. Sowry and Dowrick. Ltd., plumbers, of Waipukurau, tor £202 6/3 against the Waipawa Hospital Board and Messrs. Hillcn and Howard, builders, of Hastings. The Magistrate, in his written judgment, points out that the claim was made under the Wages Protection and Lien Act 1908, and was for the balance of money due under a subcontract and for a charge on the monies remaining in the hands of the employers. There was no dispute about the amount involved, and it was admitted that the balance was owing and the amount with the costs had been paid into Court. The Magistrate said that, as he understood the position, the one and omy question was whether the proceedings were taken in time. The judgment concluded as follows:—“As it is clear that the work done by claimants was part of the work the claimants had bargained to do, I hold that the contract between claimant and defendant was not completed till claimant had finished it. This the claimant did prior to and on the 24th .day of February 1930. Notice of claim of lien was sent to the Waipukurau Hospital Board on 10th. Marcli On the 6th. March the defendant company went into voluntary liquidation. On the 18th. March notice of the claim of lien was served on the liquidator. The plaintiff proceedings are therefore in time I propose to enter judgment for the claimants for £202 10/3 (less the sum of £5 ■ an agreed set-off) together with court costs £l6 14/-.” At last night’s meeting of the Central Hawke's Bay Rugby SubUnion the Onga Onga Club notified that they were unable to carrv on in the senior competition. The chairman (Mr. Williams) stated it would be with much regret that Onga Onga would have to withdraw from the competition, as it. would be detrimental to the game. He thought there was stilt a chance of keeping them if the union held a meeting amongst players and supoprters at Onga Onga. The union considered the idea an excellent one and it was decided to endeavour to hold the meeting on Tuesday evening next.
