PURCHASE OF COWS
ALLEGED LOSSES. CASE IN HASTINGS COURT. At the Hastings Magistrate’s Court to-day, before Mr A. M. Mowlem, S.M., George Castleton Lowe, of Hastings, farmer (Mr E. J. W. Hallett), sued Mary Moynahan, of Hastings, widow (Mr E. L. Commin), for £122 8s 9d for alleged losses in connection with the purchase of 58 cows from defendant, which were alleged to have been represented as being in a condition to calve on or about dates listed by defendant's agent. It was subsequently disovered that 14 of these cows were not in calf, and in consequence plaintiff bad to dispose of them at a loss. Mr Hallett in the course of stating plaintiff’s case, said that the cows had been valued by valuers representing Mr Lowe and Mrs Moynahan respectively, with Mr H. N. Stewart as arbitrator, and the cows were finally valued at £9 a heart, as being cows in calf. If they were not in calf they would be only worth £1 or £5. Fourteen were found not to be in calf a month after, and Mrs Moynahan was written to asking her to take the cows back ami to return the money, which she, through her solicitor, declined to do. Plaintiff had paid £9 per head for cows only worth £4 or £5. (Proceeding.)
