NAPIER MAGISTRATE’S COURT.

CIVIL CASES. Sitting in civil jurisdiction at the Napier Magistrate’s Court yesterday morning, Mr J. W. Pqynton, 5.51.. gave/judgment for plaintiffs in the following undefended civil cases: W. H. McKhy v. A. and G. Bulliss, £6 7'6, costs 26 6; Vernon Smith i. H. Tilsey, £lO4 13.8, costs £6 17/-; H. R. Murton and Co. v. H. Bodley, £7 5 -, costs 23 6; Beresford ana Roberts v. T. Dillon, £2 2;-, costs 10 -; S. Glazer v. Percy A. Carter, £1 10. -, costs 5 -. JUDGMENT SUMMONSES.

George Colleio was ordered to pay A. Golding £o 10/5 forthwith, in default six days’ imprisonment, warrant not to issue i£ amount paid, in instalments of £2 per month, first payment to be macle by March 12. \V. O'Reilly was ordered to pay A. Golding £2 18/6 forthwith, in default three days’ imprisonment, warrant not to issue if amount paid by April Ist. S. Brereton w-as ordered to pay H. A. Goodall £23 4)3 forthwith, in default 24 days’ imprisonment, warrant to be suspended provided monthly instalments of 10/- each are forthcoming.

A DEFENDED ACTION. In a defended civil action Mating and Co. (Mr Gleeson) sued AV. J. Wright (Mr Dolan) for £122 13/10, being value of a number of Avon tyres which were destroyed by fire in the latter’s garage in May, 1916. Defendant agreed to become representative for the plaintiff firm and stock Avon tyres on consignment, at the same time holding himself responsible for any Jobs or damage to the tyres. Defendant- failed to insure the tyres, and in January, 1917, his garage, together with a certain number of tyres valued at £122 13/10. were destroyed by fire. The case for the defence broke down shortly after opening, and judgment was consequently given for the plaintiff company, together with £7 2/- costs.
