MISCARRIAGE OF JUSTICE.

JUDGE EDWARD’S STRONG COMMENT.

New Pymouth, Feb. 6. In the Supreme Court to-day Frank Rattenbury, settler, Waitara district, pleaded not guilty to breaking and entering Hatrick’s warehouse, Waitara, and stealing 23 cases of whisky. The jury, after three hours’ deliberation, returned a verdict of not guilty. Mr. Justice Edwards remarked that the verdict of the jury was not his, adding that the prisoner was a very lucky man. Diedrik Wohlert (seaman), who had pleaded guilty to the, same charge, was brought up for sentence. Mr. Justice Edwards said it was an outrage on justice to punish Wohlert when the main culprit escaped. Accused was admitted to probation for two years.
