STATEMENT OF MB. FISHEB. As regards Mr. Ferard' s letter to the Herald, the facts are as follows :— On the 1 10 th November, Mr. Eerard was, at the general meeting of shareholders, elected a trustee ; at the same time the rules were passed, one of which appoints him one of the three trustees. On the 13th November I intimated this appointment to Mr. Ferard, but received no reply until the 29th (dated 27th), before which I had copied and sent the rules to the revising officer. Mr. Perard now admits that he was iv Napier during these sixteen days, but saya the person who obtained the letter from the post-office mislaid it. I contend that it was quite natural I should take silence as consent, and it is obvious I had no alternative but to send the rules as passed, according to instructions, after giving reasonable time for objections. Mr. Ferard also states that he did not receive a prospectus until after the meeting. As I sent it at least a week or ten days previously, this also was, I presume, " mislaid." The rule referred to provides for the resignation of trustees, and as Mr. Ferard has not been called upon to act, and the proper steps to fill up the vacancy are being taken (in the meantime the names of the other two trustees being sufficient), I see no reason why Mr. Ferard should feel so much aggrieved. I flatter myself that ere long those whose names have been connected with, the establishment of such a society will feel it to have been an honor rather than a grievance. Wm. Fishes.
