RESIDENT MAGISTRATES' COURT.
Wednesday, October 13. (Before John Curling, Esq., R.M.J Forgery. William Fkancis (who had just arrived in custody by the Mahia cutter) was brought up, charged with having, on the 30th September last, feloniously altered a certain cheque from one pound to ten pounds, and uttered the same, with intent thereby to defraud E. A. Carlyon or W. R. Robinson. Mr. Lee appeared for the prisonei'. W. A. Charlton, assistant to W. R. Robinson, deposed to the prisoner having bought a suit of clothes for £3, and tendered in payment a cheque drawn by E. A. Carlyon for £10, receiving the goods and £7 in change. W. R. Robinson deposed to the cheque in question being objected to at the Bank of New Zealand on the ground of its being dated the 31st September. He then took it to Mr. Carlyon, who pronounced it to be a forgery, inasmuch as the cheque had only been drawn for £l. E. A. Carlyon deposed that he owed prisoner an account for 9s. 6d, and he drew a cheque for £1 in payment, receiving 10s. 6d. in change. The word £1 in the corner, when he next saw the cheque, had been altered to £10, and the body otthe cheque, which he left blank (thinking it would be cashed at once at Swan's bar) had been filled up in words, " ten pounds." Those words were not in his writing nor authorised by him. Thomas Scully, Inspector of Police, deposed to receiving information of the forgery, and to his following the prisoner to Wairoa, where he apprehended him. On being charged with the forgery he denied it, and said he would make somebody suffer for it. The prisoner declined to say anything in his defence, and was committed fot trial.
